14. SMS and Text Messaging
We are involved in text messaging in three ways: Watson, our workforce notification service, described below; messages we send from Hit Select Agency to people who contact us or become clients; and messaging systems we build and operate for our clients, where the client is the sender and decides who is enrolled.
14.0 Mobile Information Sharing
Hit Select Agency maintains strict privacy practices. Personal information and mobile information collected through any of our text messaging programs is not sold, shared, rented, released, or traded to third parties for marketing or promotional purposes. We do share information with subcontractors who provide support services, such as our messaging platform and carrier partners, strictly so that messages can be delivered. Text messaging opt-in data and consent records are never shared with any third party for any other purpose.
14.0.1 Messages From Hit Select Agency
If you give us your mobile number and agree to be contacted by text, we may text you about your inquiry, your project, or scheduling. Message frequency varies. Message and data rates may apply. Reply STOP to opt out at any time, or HELP for help. Opting out of text messages does not affect the service we provide you.
14.0.2 Messages We Send for Clients
When we build or operate a texting program for a client, that client decides who is contacted and is responsible for obtaining consent. Hit Select Agency acts as a service provider. Opt-out requests are honored across that client’s program, and we never use a client’s contact list for our own marketing.
Hit Select Agency operates a text-messaging service under the DBA “Watson.” This section explains how mobile numbers are collected and used in connection with that service.
14.1 Program Description
Watson is an operational and transactional workforce-notification service. Client companies (employers) use Watson to prompt their own technicians, employees, and authorized personnel to upload job photos and social posts. Watson does not send marketing or promotional text messages. No advertisements, sales offers, promotions, or purchase receipts are sent through the program.
14.2 Mobile Information We Collect and How
We collect the mobile telephone number of each enrolled individual, together with the associated consent record, opt-in and opt-out status, message delivery status, and the content submitted in response to prompts (such as job photos and social posts). Mobile numbers are entered into the Watson portal by the client company that employs or engages the individual. We do not collect mobile numbers from the general public through this program.
14.3 Express Written Consent and Opt-In
Consent is collected by the client company inside the Watson portal. When adding each phone number, the client company must check a box confirming that it has that individual’s permission to enroll them in the service, and must agree to language of the form: “Do you agree to receive text messages from Hit Select DBA Watson?” Consent is captured per phone number — one checkbox per number. Blanket or bulk list uploads without per-number consent are not permitted.
After a number is added, the individual receives a confirmation (double opt-in) message and must reply YES to activate the service. A sample confirmation message reads: “You were chosen to upload job photos and social posts. Msg frequency varies. Msg & data rates may apply. Reply YES to opt in, HELP for help, STOP to opt out.” Nothing further is sent unless the individual replies YES.
The client company is responsible for obtaining and attesting to each individual’s consent. Hit Select Agency DBA Watson retains the consent records associated with each enrolled number.
Consent to receive text messages is not a condition of any purchase, of employment, or of receiving any of our services.
14.4 Message Frequency and Cost
Message frequency varies. Message and data rates may apply. We do not charge a fee for the text messages themselves; your mobile carrier’s standard messaging and data rates apply.
14.5 Opting Out (STOP) and Getting Help (HELP)
You may cancel at any time by replying STOP to any message from the program. After you reply STOP, we will send a single confirmation message and will not send further messages unless you opt in again. Reply HELP to any message for assistance, or contact us at info@HitSelectAgency.com or (801) 796-2393.
14.6 Carrier Disclaimer
Carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission from your wireless service provider and is not guaranteed. The service may not be supported by all carriers or on all devices.
14.7 No Sharing or Sale of Mobile Opt-In Data
Mobile opt-in data and consent will not be shared with or sold to any third parties or affiliates for marketing purposes. Mobile numbers and consent records are used solely to operate the Watson service and are shared only with the messaging and telecommunications providers strictly necessary to deliver the messages you have opted in to receive, and only for that purpose. No mobile information is sold, rented, or disclosed to third parties or affiliates for their own marketing or promotional use.
